All the photographs for sale on this site have been catalogued and registered for several years and have been considered creative works resulting from the author’s ingenuity and therefore (unlike simple photographs), they are legally protected for the duration of 70 years from the death of the author himself. The moral rights belong to the author, while the material rights belong to LE SICILIANE who is the owner. Therefore, all the images and photographs for sale on this site, as well as all the images shown on the site itself, belong to LE SICILIANE and are sold exclusively for private use, i.e. for decorative use or for collection purposes. Therefore, any different use is prohibited, such as their reproduction or copy, even partial, or their re-proposal for illustrative purposes. All violations have been and will always be prosecuted according to the terms of the law. Therefore, any use other than that listed above must be authorised in writing by LE SICILIANE, by submitting a specific request to our e-mail address.

These general conditions of sale govern the methods and conditions of sale of the products marketed by LE SICILIANE.

All contracts for the sale of Products by LE SICILIANE to third parties (the “Customers”) are governed by these General Conditions, which form an integral and substantial part of each proposal, order and order confirmation for the purchase of the products themselves. The conditions of sale applicable to orders are those in force on the date of the order itself.

Unless otherwise indicated, the prices of the products published on the site by LE SICILIANE are expressed in Euros and must be understood as inclusive of VAT.

The price guaranteed to the buyer is the one published on the site at the time the order is sent. The price established at the time of purchase is fixed and definitive.

The prices of the products published from time to time by LE SICILIANE on the site cancel and replace the previous ones and are subject to the actual availability of the products.

The images of the products are indicative and not binding.

Each order of products sent to LE SICILIANE constitutes a contractual proposal from the Customer. The processing of the order by LE SICILIANE is equivalent to confirmation and acceptance of the same. The tax documentation relating to the products ordered will be issued by LE SICILIANE at the time of shipment of the products themselves to the Customer.

An invoice will be issued, the Customer must indicate the exact data necessary for invoicing and specify the shipping address of the invoice itself.

It is possible to purchase from many other countries, shipping costs are calculated at checkout. It is possible, however, that some heavy products, such as sculptures, may require a small surcharge in some countries. In this case, you will be contacted promptly to provide the details.

The order will be executed within the terms specified on the site.

In the event of failure to execute the order by LE SICILIANE (if this is due to unavailability of the products ordered by the Customer), LE SICILIANE will inform the Customer as soon as possible of the expected delivery times for the supply of the missing product. If the Customer does not intend to wait for this time, in any case not exceeding 15 working days, LE SICILIANE will refund any sums already paid by the Customer for the supply not performed.

In the event of breakdown, exhaustion of the stock(s) or unavailability of the ordered product, LE SICILIANE undertakes to inform the Customer as soon as possible and to specify a deadline for availability.

The Customer will confirm by email his choice, that is, to wait for the availability of the product or to request a refund.

The conclusion of the contract will only take place upon confirmation of the order by LE SICILIANE.

The Customer will receive by fax, post or email a notification of receipt containing the order confirmation with all the elements constituting the contract (products ordered, prices, delivery dates, shipping costs, etc.)

LE SICILIANE reserves the right not to confirm an order for any reason relating in particular to a product supply problem, or to a problem regarding the order received.

In case of data entry errors made during the purchase, the Customer can send written communication to the address info@lesicilianeofficial.com indicating the incorrectly entered data and the correct data. If the order has not yet been processed and non-modifiable documents such as invoices or waybills have not been issued, we will promptly make the necessary changes.

The products are delivered to the address indicated by the Customer. Shipments will take place after receiving confirmation of payments: for bank transfers, the credit to our current account is valid, for payments by credit card and PayPal, the confirmation of the transaction by the circuit. For our shipments we rely on the service of qualified express couriers such as SDA, UPS, TNT, FEDEX to guarantee the quality of the service and the integrity of the products.

The shipping terms indicated on the site, although carefully evaluated, must be considered non-binding for LE SICILIANA, which can subsequently confirm or modify them, depending on its actual needs. Unless otherwise indicated, shipments take place within 2/3 working days for Italy and 5/6 working days for European destinations, for all products indicated as “available”. Original prints and photographs are shipped 3/7 days after receiving the order. Sculptures, such as Moor’s heads, produced in limited numbers, are shipped within 48 hours of receiving the order; if not available, up to 15 days are required for production in our artisan workshop.

The shipping term of an order containing items with different delivery times is equal to the longest shipping term of the items in the order. Any delays in deliveries of less than 30 days do not entitle the Customer to refuse delivery of the products, nor to claim compensation or indemnity of any kind.

LE SICILIANE has the right to carry out, if it deems it appropriate, the delivery of the products (even relating to the same order) in several successive deliveries.

Delivery is considered to have been carried out from the moment the product is delivered to the Customer.

The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the product, will constitute proof of transport and delivery of the goods.

It is important to know that:

Upon delivery, the Customer must verify the content, conformity and condition of the product(s). Therefore, upon delivery, LE SICILIANE recommends that the Customer proceed to verify the condition of the delivered products before signing the acknowledgement of receipt, and in particular:

• That the number of packages delivered corresponds to that indicated in the transport document attached to the shipment;
• That the packaging is intact, not damaged, not wet or in any way altered, and that the contents are checked for integrity.

If the Customer finds any anomalies, he/she must write down his/her reservations, detailed and dated. Such reservations must be communicated to the email address of Le Siciliane.

If the courier’s document is signed without adding any “reservations”, the Customer will not be able to raise any objections regarding the external characteristics of the goods delivered.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery.

LE SICILIANE has the right, at its sole discretion, to deliver the products ordered by means of a courier of its choice. Unless otherwise indicated, all deliveries are made at street level.

Special delivery terms and conditions must be previously agreed between the Customer and LE SICILIANE and accepted in writing by LE SICILIANE.

In the event of the recipient’s absence during delivery, the carrier will leave a notice of passage at the delivery address indicated by the Customer. The products must be collected at the address and in the manner indicated by the carrier.

In the event of failure to collect within the deadline established by the carrier, the products will be returned to Le Siciliane, which reserves the right to refund the price of the products, leaving the shipping costs to be paid by the Customer.

In the event of an error relating to the product, the Customer undertakes to return said product or products concerned to LE SICILIANE within 7 days of receipt, provided that they are returned with the closed package, in their original condition and packaging with the accompanying documents.

Once the product has been received in the correct form and manner, LE SICILIANE will resend, at its own expense, the product initially ordered.

In addition to those normally considered by jurisprudence, the following cases are explicitly considered as cases of force majeure:

Total or partial strikes, internal or external to the company, blocking of means of transport or supplies for any reason, government or legal restrictions, computer failures, blocking of telecommunications including networks and in particular the Internet.

In the event of force majeure, the execution of the order will be suspended, initially, by right.

If after a period of 3 months, the parties note the persistence of the case of force majeure, the order will be automatically cancelled, unless otherwise agreed by both parties.

Any complaints for defective or damaged goods must be sent by email to info@lesicilianeofficial.com no later than 8 days after receiving the goods. The email must include the order number, the number of pieces, the number and date of any receipt or invoice for the products reported. It is also required to attach a photo of the damaged products. The return of goods must be previously authorized by LE SICILIANE by phone or email. Returns, once authorized, must be sent to LE SICILIANE, accompanied by a regular delivery note and the relevant purchase details, to the address that will be provided to you.

In accordance with Legislative Decree 6 September 2005 n. 206 (Consumer Code), the consumer, i.e. the natural person who has purchased, at a distance, goods for personal purposes, not related to his/her work activity, has the right to withdraw from the contract, without any penalty, within 14 days from the date of receipt of the goods. Pursuant to art. 67 paragraph 3, all direct costs of returning the goods are borne by the consumer. To exercise the right of withdrawal, the customer must:

• Make sure that the products to be returned are intact in all their parts, including the packaging. For t-shirts and sweatshirts and in general for all clothing items, it is important that the tag has not been removed and obviously they have not been washed.

• Send the products to the address provided by us.
• Alternatively, you can request the collection service at a cost to be assessed based on the country, we will take care of sending the courier to your address.
• In accordance with art. 67, paragraph IV, Consumer Code, only after receiving the product(s) and only after having positively verified compliance with the terms and methods for exercising the right of withdrawal, as well as the integrity of the products, LE SICILIANE will proceed, as quickly as possible, and in any case, within 30 days from the date on which it became aware of the exercise of the right of withdrawal, to reimburse the sums paid by the Customer. The amount of the reimbursement will be communicated via e-mail or telephone and credited according to the methods indicated by the customer. The Company does not reimburse shipping costs for the return.
• The customer is responsible for shipping; LE SICILIANE will not be liable for damage or loss of products shipped by the customer without insurance. Damage to the goods during return transport is not covered by LE SICILIANE, but only by the customer’s courier (if the goods have been insured). In any case, if the product arrives damaged, the refund procedure will be suspended.

Payment for the order/order of the consideration is due from the moment of the order.

The Customer undertakes to pay the agreed price for the product ordered on the site (price of the products and transport) as well as to pay or have paid, if necessary, and this directly to the courier or transporter, the VAT or other taxes relating to the importation of the Products in the countries where the delivery will take place.

The Customer pays for the order:

– By credit card as proposed on the site.

The Customer guarantees to LE SICILIANE that he has any necessary authorisations to use the card payment method during the order phase.

– By bank transfer, as proposed on the Site.

In the event of failure by LE SICILIANE to receive the transfer within 14 days of confirmation of the order, LE SICILIANE reserves the right to cancel the order. The bank details are provided at the time of the order.

The products ordered remain the property of LE SICILIANE until final and full payment of their price (pursuant to Art. 1523 and following of the Civil Code). Le Siciliane reserves the right to claim the products ordered in the event of non-payment.

In this case and upon request of LE SICILIANE, the Customer undertakes to return any unpaid product, at his own expense.

Complaints for non-compliance of the product(s) delivered with the order must be sent in writing directly to LE SICILIANE, immediately after receiving the goods.

The Customer must keep the original packaging and the delivery document.

The computerized processing of information, including the management of the email addresses of the users of the site, is carried out in accordance with the provisions of the law. The nominative information requested from the Customer is essential for the processing and forwarding of orders, the creation of invoices and any warranty contracts.

To avoid any attempt at fraud, LE SICILIANE may ask you for proof of your identity, your domicile.

The “Validation Click” constitutes an electronic signature.

This electronic signature has the same value between the parties as a handwritten signature.

For LE SICILIANE, the fact of not asserting a failure by the Customer with respect to any of its obligations cannot be interpreted as a waiver of the obligation in question and the possibility of asserting this failure at a later time.

These general conditions of sale constitute the entirety of the obligations of the parties. No other general or particular condition communicated by the Customer may be inserted or excluded from these general conditions.

LE SICILIANE is the owner of the intellectual property rights of the site and the right to disseminate the elements contained in the online store catalogue, consequently, the partial or total reproduction, on any type of support, of the elements that make up the site and the catalogue, their use as well as their transfer to third parties are formally prohibited.

If one or more provisions of these general conditions are considered invalid or declared as such pursuant to a law, regulation or following a final decision taken by a competent jurisdiction, the other provisions will retain all their force and value.
